By using our website, which includes access through other digital platforms such as our app, you confirm that you accept these Terms of Service (“terms”) as binding upon you, including additional terms and conditions and policies referenced herein and/or available by hyperlink, and that you agree to comply with them. If you do not agree to these terms, you must not use our website.


Terms and Conditions of tigh design

Working Hours

tigh design operate the following hours:

tigh design offer a range of appointment times and outside of these times we are not available. 


Annual leave.

tigh design will be closed from Friday July 1st – July 22nd. Adequate notice will be given regarding any additional leave.


Steps to take when you starting to work with tigh design

It is advisable that you notify your contractor that you will be appointing the services of tigh design as early as possible to avoid over-runs at a later stage in your project. Any recommended changes to specification regarding finishes and other, may result in an increase in costs including labour and/or materials.  (eg a change in tile or pattern proving more labour intensive and/or additional light fittings affecting increased labour and materials costs etc.)  


Site Support and tigh design Quality Check.  

This is part of the design process to ensure all specifications are met and for quality control purposes.  Please allow for a minimum of 10 hours site work for qualitative purposes which may be at least 6 months after contract delivery.  This is non-optional. 

3.2 Showroom visits.

The number of visits on each project can greatly vary. As a general rule I recommend two suppliers maximum (regarding kitchen and bathrooms unless we look at bespoke cabinetry) and tigh design will accompany you initially and before signing off.  It is at your discretion should you wish to visit more showrooms unless you specifically request me to accompany you.  Please allow adequate notice of any suppliers going to site.


Fees and Hours 

Project hours- How I allocate client hours depends on the project size, the building        phase and external constraints.  All clients will be notified in advance of these. 

Phone and Email- There is a 24 hrs turn around response to phone and email. Any calls after 18.00 will not be answered- unless urgent. Text URGENT to 0861724681 if you require a response (as I may not pick up on email after business hours).

Punctuality- If a client is more than 15mins late, then they will be charged for this time and depending on tigh design’s schedule we may not be able to stay later in projects once the allotted time has expired.  

Travel time- tigh design retains the right to charge for travel time. These fees are set at €70 p/h after first 35mins travel time within Cork County.   (eg Kinsale – Cork round trip chargeable at €35.00) Please enquire for projects outside cork county.


tigh design 25min clarity call

tigh design offer a free 25 min clarity call.  Once this call has taken place and the client has entered into an agreement with tigh design, we require 5 working days to guarantee ‘time slot’. Before tigh design engages in your work, we require with a 50% deposit.  


Payment terms and invoicing. 

tigh design will invoice based on a 20-hour retainer package; with 50% due in advance of hours to be rolled out.  You will be notified when 17 hours are absorbed on each package.  Further Works will not be progressed until deposit is received on retainer (please note that this may affect deadlines at early build phase).  Any hours spent on your project that are outside the agreed hours will be charged on an individual basis which will be at a higher rate then the retainer hours. 

Cancelling pre-arranged appointments 

tigh design have a set schedule every week and work with a variety of clients. If your circumstances change then tigh design require a minimum 24-hour cancellation policy for site meetings/other. Failure to cancel your appointment before 24 hours (except in exceptional and one-off situations) will be chargeable. Cancellation Policy.

tigh design can only work with a client if the relationship is open, transparent, and reciprocal. If either party feels that the relationship between the client and tigh design has broken down, then tigh design and/or the client retain the right to withdraw from the agreed contract. All efforts will be used to re-establish the lines of communication between all parties but if this fails and it is agreed to terminate the contact then 48hrs notice from either party is the minimal amount of time required to close off all outstanding work and invoices will be produced to cover all due monies on your account. 


How tigh design process with a project. 

This will depend on the client’s level of ownership on the project and on their level of involvement in decision-making.

We can decide on a weekly or bi-weekly update depending on the building phase.

  • A note on design. 

Please note that design is a process and not an immediate ‘visual fix’ or ‘idea’ and therefore takes time and is difficult to quantify. Any presented solutions may not always translate directly on site which may require some fine tuning before it is correct.  A certain amount of patience helps before seeing any results initially.

  • Hard copies

Please retain any hard copy of drawings I forward for future reference. These will entail crucial dimensions when shopping for fittings and soft furnishings at a much later date (eg rugs If tigh design is not on board at this point.)  

  • Assumptions. 

Please DO NOT make any assumptions and contact me for clarity purposes no matter how minor you may deem the issue to be.  Having an open and honest communicative relationship will result in the very best end product.

  • Project management

Please note that tigh design do not operate a project management service at this time but work in liaison with your contractor and/or nominated project manager.

  • Client meetings. 

Every conversation between tigh design and the client will be summarised, forwarded, and approved by the client before progressing any works.  Ideally this will follow within 24 hours following meeting/call but due to the high volume of decision-making at the early stage of the project, it may not be always possible to meet this timeframe.

  • Issue of Drawings. 

Any proposal forwarded in sketch/ drawing/visual format to the client will be titled IFA drawings (issue for approval). This is for the Clients EYES ONLY and NOT for Site.  Only when these drawings/details have been approved by the client, they will be upgraded by tigh design to IFC drawings (issue for construction) for issue to site as standard practice.    Each IFC drawing will accompany a Drawing register which documents the number of the drawing and to whom it was forwarded.  (eg main contractor, electrician or painter). IFA drawings do NOT contain adequate information to carry out works and should NOT be used for quotation purposes with suppliers or other etc as it only leads to miscommunication and/or rework at a later point. Detailed drawings for shelving eg will be issued separately as an IFC drawing (a GA general arrangement drawing will not provide adequate information to complete correctly). 

tigh design cannot be held liable if works proceed without these drawings. 

  • Site Support.  

This will be included as part of the various solutions with visits to suit the clients’ needs, ensuring all specifications are met and for quality control purposes.  It is the client’s responsibility (ie Their main Contractor) that all sub-contractors show up to site with correct instruction. (A professional site will follow best practice).

Any details regarding on or off-site meetings between contractor and/or sub-contractor where the client isn’t present, will be forwarded to the client and attending party for clarification purposes.  (This does not include the taking of minutes).

  • On site modifications. 

tigh design will not be held liable for any rework effecting the end vision regarding on site modifications instructed by you the client, to a nominated contractor (these will be charged as an over-run) without communicating to tigh design in advance.

  • Furnishing and fittings:  

Where applicable I will recommend and source these from light fittings to furnishings; These will all be confirmed and approved by you in advance where I organise payment links between appointed suppliers which I then forward to you for organising.  (tigh design does not currently take ownerships of these unless pre-arranged with the client).

  • Accessories. 

tigh design generally recommend a budget on each project that allows tigh design to ‘pick up’ one off items we deem suitable for your project that might include cushions, throws, handles, hanging accessories and in some cases light fittings. This budget generally starts at €500 - €1,000.00). tigh design look for your approval in advance of any larger items etc. invoicing you when we have reached the agreed amount.  This is completely optional.

  • Design Proposals: 

All proposals issued including plans, elevations and any detailing are currently hand-drafted by tigh design; (in the middle of software upgrade) this does not in any way diminish the contents credibility.  These will be issued as standard practice and updated/revised accordingly.

  • Kitchen Proposals.  

Detailed plans and elevations are rendered in similar format and dimensioned to enable kitchen supplier to furnish an accurate quotation at time of issue.  (A rendered, 3D colour format will be available from the kitchen supplier due to the compatibility of their software).  Cabinet dimensions are subject to variation between suppliers but can be modified to suit the approved Kitchen Layout).

  • Joinery. 

Please note that any joinery requirements will require separate detailed drawings; any plans/ elevations indicating proposed positioning on a GA are for layout purposes only.

  • WhatsApp note!  

Please do not forward any imagery on WhatsApp unless tigh design have agreed a time frame that you will be product sourcing.  Every item we recommend or specify for your project is considered with the end vision in mind in terms of scale, proportion, finish, functionality, and colour to name but a few.  Without wanting to offend you, tigh design like to give an explanation as to why an item isn’t always suitable and reviewing every image can be incredibly time consuming where we sometimes need to refer to drawings and is chargeable time.

  • A Note On Wear And Tear.  

The materials tigh design specify are for how they endure and how they improve with age over time under general use.  Obviously, the boundaries we set within our homes vary greatly regarding our children and family pets!  If we specify a material for a couch, we will assume that it won’t be jumped on and that boots, shoes etc will be removed before lying on it.  The same will apply to a wooden table or countertop; If these are used for applying toxic materials to a product, like paint or permanent marker, tigh design will assume a covering will be utilised to protect the surface and tigh design cannot be held accountable for any damage to these surfaces.  Please advise us in advance should you require specific materials that are fit for purpose.

  • Photographs and social media

As part of our process, tigh design take photographs before and after the work has been carried out for documentation purposes. We also reserve the right to use these pictures on our social media but we will not share any personal details about the property. 


Terms and Conditions of Service of business 

Indemnification, Liability, And Limitation

The express terms and conditions of these terms shall apply in place of all warranties, conditions, terms, representations, statements, undertakings and obligations whether expressed or implied by statute, common law, custom, usage or otherwise, all of which are excluded to the fullest extent permitted by law.  Insofar as it is lawful to do so, we do not accept liability of any description including liability for negligence or any damages whatsoever arising out of or in connection with the viewing, use or performance of this website or its contents.  In the event that you reproduce, display, transmit, distribute or otherwise exploit the structure, information, material, or any portion thereof, in any manner not authorised by us, or if you otherwise infringe any intellectual property rights relating to the structure, information, photographs, prints or this website, you unconditionally and irrevocably agree to indemnify us and keep us indemnified from and against any and all losses, expenses, costs or damages, including reasonable lawyers’ fees, incurred by you or others as a result of unauthorised use of the above and/or your breach of these terms.  You unconditionally and irrevocably agree to indemnify us and keep us indemnified from and against all and any losses, costs, claims, liabilities, damages, demands and expenses suffered or incurred by us and arising from any claim brought by any third party against us howsoever arising from or in connection with: these terms; the supply of the services and/or digital goods pursuant to the terms; your use of the services and/or digital goods; or your fraud or negligence.  For the avoidance of doubt, we will under no circumstances whatsoever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with these terms for any loss of profits, goodwill, sales, business, or revenue; loss or corruption of data, information or software; loss of business opportunity or anticipated savings; or any indirect or consequential loss.  Without prejudice to other clauses in these terms, our total liability arising under or in connection with these terms, whether arising in contract, tort (including negligence) or restitution, or for breach of statutory duty or misrepresentation, or otherwise, shall in all circumstances be limited to the purchase price paid for the relevant services that is/are the subject of a claim.  

Errors, Inaccuracies And Omissions

Occasionally there may be information on our website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the website or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).  We undertake no obligation to update, amend or clarify information on the website or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied on the website or on any related website, should be taken to indicate that all information on the website or on any related website has been modified or updated.

Sales Of Services 

If you are not a consumer, you confirm that you have authority to bind any organisation on whose behalf you use our site to purchase services. We reserve the right, but are not obligated, to limit the sales of our services to any person, geographic region, or jurisdiction.  We may exercise this right on a case-by-case basis.  We reserve the right to limit the quantities of any services that we offer.  We reserve the right to discontinue any service at any time.  In accordance with other clauses included in these terms, we make no express or implied warranty, representation or undertaking and assume no responsibility concerning the quality, nature, or fitness for purpose of the services or digital goods.  We do not warrant that the quality of any services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the products or services will be corrected, unless as required by law.   All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from these terms. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion.  Prices for our services are subject to change without notice.  We reserve the right at any time to modify or discontinue our services on our website (or any part or content thereof) without notice at any time.  We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of such.

Refunds

We conform to Irish and EU law and regulations for the purposes of whether or not to accept returns. We deal with cases as they happen on an individual basis.  We encourage you to contact us as soon as possible after delivery should you discover a fault or defect in the services or digital goods.

Social Media Platforms 

Communication, engagement, and actions taken through external social media platforms that we participate on are custom to the terms as well as the data protection and privacy policies and notices held with each social media platform respectively.  You are advised to use social media platforms wisely and communicate / engage upon them with due care and caution regarding your own privacy and personal details.  We will never ask for personal or sensitive information through social media platforms and encourage you when wishing to discuss sensitive details to contact us through primary communication channels such as by telephone or email.  

Data Protection, Privacy And Security 

Your rights to data protection and privacy, including security over data, are very important to us.  We treat personal data obtained using this website as private and are committed to providing you with secure access to our online service.  This website processes information from you as per our Privacy Statement.  When you, amongst other actions, visit our website, enquire about services or send e-mails to us you understand that subsequent data processing will be done as detailed in our Privacy Statement.

Governing Law And Disputes 

This website is hosted, controlled, and operated from the Republic of Ireland and therefore governed by Irish law, subject to the terms of Public International Law.  In the event of any dispute of any nature whatsoever arising between the parties on any matter provided for in, or arising out of this agreement, the Irish law will apply, and the appropriate courts of the Republic of Ireland will have jurisdiction.

Variation Of These Terms & Conditions 

We reserve the right to make changes to this website, these terms, and the other information contained in this website at any time and without notice.  Please refer to these terms when you visit the website as they may change from time to time.

Severability

In the event that any provision of these terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

Waiver

The failure of us to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision.

Entire Agreement
